1. Acceptance of Terms

By accessing or using the AppPainPong web application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

AppPainPong is an AI-powered platform that analyzes publicly available App Store reviews to help independent developers identify user pain points and discover product opportunities. The Service includes review collection, AI-driven analysis, pain point clustering, and product idea generation features.

3. Account Registration

To use the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 16 years old to create an account.

4. Subscription & Payments

The Service offers a free tier with limited features and a paid Pro subscription. Subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

  • You may cancel your subscription at any time through the account settings or Stripe Customer Portal.
  • Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until then.
  • Refunds are handled on a case-by-case basis. Please contact us within 7 days of a charge if you believe it was made in error.
  • We reserve the right to change pricing with 30 days' prior notice to active subscribers.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to circumvent usage limits, rate limits, or security measures
  • Use automated tools, bots, or scripts to access the Service beyond normal use
  • Resell, redistribute, or sublicense access to the Service or its data
  • Interfere with or disrupt the Service or its underlying infrastructure
  • Reverse engineer, decompile, or attempt to extract the source code of the Service

6. Intellectual Property

The Service, including its design, code, AI models, and branding, is owned by AppPainPong and protected by intellectual property laws. The analysis results and insights generated for your account are provided for your personal or internal business use only.

App review data analyzed by the Service is publicly available information from the App Store. We do not claim ownership of this third-party content.

7. Limitation of Liability

To the maximum extent permitted by law, AppPainPong shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated analysis, insights, or product ideas. Any business decisions based on the Service's output are made at your own risk.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in abusive behavior. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AppPainPong operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
